Types of Personal Injury Lawsuits

Personal injury lawsuits are intended to help injured parties collect compensation from the person whose negligence caused their injury. There are many areas for a person’s personal liability may result in a personal injury lawsuit against them. This would include situations of medical malpractice, auto accident, defective product, workplace injury, and premises liability among many other injurious situations.

For instance, in a situation where a person causes an accident while driving under the influence of alcohol or a controlled substance they are responsible for any injuries inflicted upon their passengers and passengers in the other vehicle. The party at fault's liability in this situation is not limited to the victim's present medical expenses. Liability extends to future related medical expenses and loss of income. You may even be responsible to pain and suffering.

Medical malpractice is another common type of personal injury lawsuit that people file. This happens when a doctor does something negligent that cause injury to their patient. Examples of this type of personal injury lawsuit may include injuries that occur during birth and cause conditions like cerebral palsy. Or, medical malpractice may occur when a person dies unnecessarily as a result of doctor’s negligence.

Defective products that cause injury can also lead to a personal injury lawsuit. A consumer can sue a company or manufacturer if a product defect causes injury or illness. This can also include medications that are defective or harmful and lead to adverse and dangerous side effects in patients that take them. An example of this would be the diet pill fen phen that causes many people to develop heart problems.

An employer that is negligent and does not provide a safe workplace can also end up have personal liability if one of their employees becomes injured as a result. Every state has safety laws that employers must adhere to protect their employees. If safety practices are lacking and an employee suffers and injury or is killed at their workplace they or their family is entitled to compensation.
